Terms of Sales

PREAMBLE
The IZAC store company - France (hereinafter referred to as "JSR Society") markets IZAC articles in France. Anxious to always better meet the expectations of its customers, the JSR company wished to set up, in addition to the store of stores it operates, a remote sale network by telephone and electronically (Internet) of some of its products. The use of the distance selling process described in these general conditions of sale is reserved only for consumers, in the sense given by law and jurisprudence, acting exclusively for their own account and domiciled in "mainland France".

 

Article 1: Fields of application
These general conditions of sale are applicable to all sales of IZAC items concluded either through the customer service set up by JSR, or via the merchant site accessible from the French version of the Izac.fr website.

1.1 Regarding the sale by telephone, any sale of IZAC items through customer service set up by JSR is concluded under the resolving condition of the acceptance of these general conditions of sale by the customer.

1.2 Regarding the sale by electronic means (Internet), the Customer declares that they have read these general conditions of sale before placing his order. The validation of his order is therefore worthless acceptance or reserve of these general conditions of sale.

In accordance with the provisions of article 1369-4 of the Civil Code repealed by order n ° 2016-131 of February 10, 2016-Art 3-, these general conditions of sale may be kept by any person visiting the izac.fr website by means of a computer registration and may be reproduced, by means of their printing; These general conditions of sale are applicable as long as they appear on the Izac.fr website. In the event that, after the date of their deletion of the Izac.fr website, these general conditions of sale would nevertheless remain accessible to the public via other websites or by any other means, they would however no longer be enforceable against JSR.

 

Article 2: Identification of the offer of the offer

Article 3: Information relating to articles
The information relating to all IZAC articles likely to be sold through the JSR company customer service is available, with their references, in all IZAC stores, as well as on the izac.fr website.

This information complies with the prescriptions required by the legal and regulatory texts in force and, in particular, by articles L. 111-1 and L.113-3 of the Consumer Code and by the ministerial decree of December 3, 1987 "relating to consumer information on prices".

 

Article 4: Products order
4.1 Orders by telephone The orders will be received, in French or in English, by the Customer Service of the company JSR either at +33 1 77 35 14 72 (price of a local call), or via the call numbers of the company's stores and this from metropolitan France from Monday to Thursday from 9:00 a.m. to 1:00 p.m. and from 2:00 p.m. to 6:00 p.m. and Friday from 9 a.m. to 5:00 p.m.
4.2 Orders by Internetles Orders may be placed on the Internet on the merchant site accessible from the French version of the Izac.fr website. The customer keeps telecommunications costs at his expense when accessing the Internet and using the Izac.fr site.

The customer must, to be able to buy a product, fill out an order form specifying certain compulsory fields so that his selection can be taken into account by JSR.
In the event of prolonged inactivity when connecting it is possible that the selection of the items chosen before this inactivity is no longer guaranteed. The customer will be invited to resume his selection of products from the start.

All the stages necessary for the sale will be specified on the Izac.fr website in accordance with the provisions of article 1369-1 of the Civil Code repealed by order n ° 2016-131 of February 10, 2016-Art 3-. Pursuant to the provisions of article 1369-4 of the Civil Code repealed by order n ° 2016-131 of February 10, 2016-Art 3-, the customer will have the possibility, before permanently validating his order, to verify the details of his order and his total price and to correct any errors, before confirming it to express his acceptance. From the moment when the customer has validated his order, the company JSR will accuse the reception of it without delay and electronically. However, the sale will only be considered final after sending the Customer to confirm the order by JSR, specifying the shipment of the items. Only the items sent will be debited.
4.3 Refusal of orders, which can be said to the provisions of article L.121-11 of the Consumer Code, the JSR company will be entitled to refuse any abnormal or placed order in bad faith, or any order from a customer with whom a dispute relating to the payment of a previous order would exist.

 

Article 5: Conditions of use of the gift card
The gift card (the ‘‘ card ’’) is the property of the JSR company, its holder being a simple depositary.

It can be purchased in store (physical card) or on the merchant site (virtual card) and is valid for a period of one year from the date of purchase in store, or if necessary, the date of sending the virtual card on the customer's email address.
The Gift E-Carte works in France only. It can be used in several times and is sent by email on the date of your choice. It is valid on the entire site or in stores (excluding franchisees, shops of Talange and Franconville).
Upon expiration of the validity duration, the card cannot be renewed or used to make purchases, and no available balance of the card can be requested.

The card is not nominative, its holder will be exclusively responsible for its use and its guard. It cannot be replaced in the event of theft, loss and damage.

In both cases, the gift card can be used for the purchase of products for sale in all IZAC stores or on the merchant site, until its total amount is exhausted and this during its entire period of validity.

The gift card will be debited with each use of the order price.

When the order price is higher than the available balance, the Customer will be asked to pay the difference by any other payment method accepted in IZAC stores or on the merchant site.

The customer can consult the balance available in an IZAC store or on the merchant site when placing an order.

The return of the gift card not yet used is accepted according to the following conditions:
• The physical card purchased in all IZAC stores can be returned within 14 days from its date of purchase;
• The virtual card purchased on the merchant site can be returned within 14 days from its date of dispatch on the email box provided by the customer at the time of the order.

In the event of withdrawal under the aforementioned conditions, the price of the card will be reimbursed with the same payment method as that used for its purchase. To request the refund, the customer must be able to justify the original receipt or the e-ticket, and if necessary, the card used to make the payment as well as the transaction receipt. E-TICKET is attached to the order confirmation email and also available on the customer account accessible from the merchant site.

The reimbursement of the products purchased with a gift card and being returned will be made by crediting the price of the product returned to the available balance of the card. If the card no longer exists or if its validity duration has expired, the price of the product will be credited in the form of a voucher or on a new gift card given:
(i) either in store for the reimbursement of products purchased in stores;
(ii) or by email to the customer's address who purchased for the reimbursement of products purchased on the merchant site.

Finally, the company JSR cannot be held responsible for the non-reception or delay in receipt of a virtual card by the Customer for all reasons independent of its will (breakdown/failures of telecommunications systems, spam, etc.), in the event of loss of information communicated to the customer, or even in the event of inaccuracy of the customer's contact details.

 

Article 6: Price of articles
The price of articles is understood all taxes included. Unless expressly stipulated otherwise when ordering made on the Izac.fr website or by phone in customer service.

The price including tax of each of the items that the Customer would like to acquire, as well as the amount of transport costs relating to their delivery, will be communicated to him either when he calls the customer service of the JSR company, or when connecting to the izac.fr website.

In accordance with the provisions of article L.221-13 of the Consumer Code, the Customer will receive, during the delivery, for each of the items, the written confirmation of the price paid detailing the price of the items and the delivery costs if necessary.

 

Article 7: Payment Conditions
The payment of customer's purchases can be carried out by bank card (are accepted the cards of the "CB" network, Visa, Mastercard, American Express). When paying by bank card, the customer's bank card is debited when preparing the order.

To this end, the Customer confirms to the customer service of the company JSR, during an order by phone, and guarantees the company JSR, during an order via the Internet, that he is the holder of the bank card and that the name appearing on this bank card to be debit is indeed his then communicates either by phone, or in a secure environment on the Internet, the number and the expiration date appearing in the front of his bank card as well as the numbers Visual cryptogram appearing on the back (or on the front) of his bank card.

Secure payment: all transactions made on Izac.fr are secure thanks to the Caisse payment system of Epargne Ile de France: SP Plus.

No banking information passes on izac.fr.

SP Plus is certified HTTPS, PCI-DSS and PCI-3DS: this means that all the information transit on this platform is encrypted and protected, and never circulate clear on the Internet.

All our payments are subject to 3D Secure; During payment, we ask your bank to authenticate you (for example by sending an SMS or connection to your online banking) in order to validate your payment.

 

Article 8: Delivery
The delivery of the items will take place after the payment of the amount of the order has been registered. In accordance with the provisions of the Consumer Code, the delivery of the items ordered will take place within the deadlines communicated by the company JSR and, in the absence of an indication, in any event at the latest within 30 days from the order, subject to the full payment of the price.

The delivery time of a product, corresponds to the period of preparation of the order, to which is added the delivery time by the carrier according to the mode of transport chosen by the customer.

IZAC cannot be held responsible for delivery delays which are attributable either to the customer, or to the unpredictable and insurmountable fact of a third party to the contract, or to a case of force majeure. All items presented are available in stock. The customer is informed that depending on the availability of the items, his order may be subject to several separate shipments.

In the event of delay in delivery in relation to the above -mentioned maximum period, the Customer may contact customer service to order them to execute the delivery within a reasonable additional time. In the event of non-compliance with this new period, the Customer may by e-mail or by letter, solve the contract and obtain the refund of his order within 14 days of the denunciation of the contract.

The free delivery in store:
Your order is delivered free of charge in the store of your choice in mainland France within 2 to 4 working days. Note: if the store is temporarily unable to offer this service, it will not be in the list of stores offered.

Delivery available at home:
Your order is delivered within 2 to 4 working days to the address you have indicated in the delivery stage during the order process.

The delivery offered in relay point:
Your order is delivered within 2 to 4 working days in the relay point that you have indicated in the delivery stage during the order process.

At the time of delivery, IZAC invites the customer to carry out any necessary examination to detect any missing, defects or other apparent or non-compliance vices of the products delivered to his order. The customer must in particular check the condition of the packaging, the number of packages and the products in their quantities, their references and their characteristics. The Customer is strongly advised to notify the carrier any reserve on the packaging and, if necessary, the condition of the products (example: open and/or damaged package).
If, during delivery, the external aspect of the package is not perfect, the customer will open in the presence of the carrier in order to verify the status of the article. In the event of damage to the item, the Customer will detail them precisely on the delivery slip, the provisions of article 11 below which are also applicable.

Delivery is ensured thanks to the Chronopost services for mainland France, Corsica and Monaco, for a period of 2 to 5 days.

ARTICLE 9: Satisfied or reimbursed - Right of withdrawal and return of items
The JSR company understands that those of its customers who are not satisfied with the articles ordered can exercise the right of withdrawal provided for in article L.221-18 of the Consumer Code in the best conditions.

Thus, the customer may exercise his right of withdrawal, without giving reason, within fourteen (30) days from the date of reception of the property. The reimbursement will take place without delay as soon as the property is returned in our warehouses. To notify his withdrawal decision, the Customer must notify us his decision using a declaration devoid of ambiguity by email at Serviceclient@izac.fr or by registered letter with acknowledgment of receipt to the address referred to in article 10.1 below. Refer to FAQs for more information concerning exchanges in stores and reimbursements.

To this end, we specify the model of withdrawal form provided for in the appendix to article R.221-1 of the Consumer Code:

In addition, the return of the gift card is governed by the provisions provided for in article 5 "Conditions of use of the gift card".

To restore the articles he would have already received the customer can return the articles by post to the address mentioned above, at their expense. In this case, the customer must, within fourteen (14) days of the communication of his decision to withdraw, return the article concerned, to the address indicated in his return voucher. Direct costs for the article will then be borne by the customer.

It will be up to the Customer to manage the proof of this return, which assumes that the items must be returned by registered shipping, or by any other means giving a certain date, the costs and risks of return remaining the customer. The reimbursement will take place immediately according to the reception, by the company JSR, of the returned items. The customer will be informed by email. The reimbursement of the sums paid for the item (s) returned (s) will be carried out, depending on the method of payment of the items, by credit on the bank account of the customer corresponding to the bank card used for payment. Pursuant to article L.221-24 of the Consumer Code, the professional is not required to reimburse additional costs if the consumer has expressly chosen a more expensive delivery method than the standard delivery method offered by the professional.

 

ARTICLE 10: Compliance - Guarantee
The customer must ensure that the items delivered to him correspond to his order. In the event that the items delivered are not in accordance with his order, the Customer must inform the Customer Service of JSR on 01 77 35 14 72 or by email to the following address serviceclient@izac.fr, before returning so that the anomaly may be noted.
Notwithstanding the specific guarantee conditions given to the customer with the article delivered, the IZAC articles are subject to the guarantee conditions provided for by law.

Reminder of articles L.217-4, L.217-5 and L.211-12 of the Consumer Code and Articles 1641 and 1648, first paragraph, of the Civil Code:

"Article L.217-4 of the Consumer Code: the seller is required to deliver a good compliant to the contract and responds to existing compliance defects during delivery. It also responds to compliance defects resulting from the packaging, mounting instructions or installation when it was charged by the contract or was carried out under its responsibility."

"Article L.217-5 of the Consumer Code:
To comply with the contract, the property must:
1 ° Being specific to the usually expected use of a similar property and, if applicable:
• correspond to the description given by the seller and have the qualities that the latter presented to the buyer in the form of a sample or model;
• Present the qualities that a buyer can legitimately wait for public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2 ° or present the characteristics defined by mutual agreement by the parties or be specific to any special use sought by the buyer, brought to the attention of the seller and which the latter accepted. "

"Article L.211-12: The action resulting from the lack of conformity is prescribed by two years from the issuance of the property."

"Article 1641 of the Civil Code: The seller is held from the guarantee due to the hidden defects of the thing sold which makes it unfit for the use to which it is destined, or which decreases this use so much, that the buyer would not have acquired it, or would have given only a lower price, if it had known them."

"Article 1648 of the Civil Code, first paragraph: the action resulting from the crumbling defects must be brought by the buyer within two years from the discovery of the vice."
The repair of the consequences of the hidden defect, when it has been proven, includes case law:
- either the completely free repair of the article, including labor costs,
- either its replacement or the total or partial refund of its price in case the item is completely unusable,
- and compensation for the damage possibly caused to persons and property by the defect of the article.

The JSR company offers after-sales service of its products. The customer can contact customer service by phone: +33 1 77 35 14 72 (price of a local call) or go to one of the IZAC stores in order to obtain more information on this service.

 

Article 11: Reclamations - Information - Mediation
11.1 - Information or prior complaint
For any information, complaint or question relating to the conditions of sale, you must contact the company's customer service as a priority at 01 77 35 14 72 (number not surcharged from a fixed line in mainland France), Monday to Friday except holidays or unemployed, from 9 a.m. to 1 p.m. and from 2 p.m. to 6 p.m. or by email at the following address serviceclient@izac.fr, Headquarters located 10 avenue de l'Europe-92300 Levallois-Perret.

11.2 - Mediation request
In the event of failure of the claim request to the consumer service or in the absence of a response from this service within two months, the consumer can submit the dispute relating to the order or to the CGV to a mediator who will try, in complete independence and impartiality, to bring the parties closer to achieve an amicable solution.

The parties to the contract remain free to accept or refuse the use of mediation as well as, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator.

Article 12: Electronic files - Private Protection of Private Life
The JSR company has been an electronic file that lists certain personal data relating to its customers. When ordering customer service or by internet on the Izac.fr website by any new customer, this database will be enriched by means of information concerning it, which will subsequently make it possible to better meet its expectations and to facilitate assistance services provided by customer service. This database was the subject of a declaration, in accordance with the prescriptions required by the law "Informatique et Libertés" n ° 78-17 of January 6, 1978, modified by law n ° 2004-801 of August 6, 2004.

In the event that the customer agrees to communicate individual data of a personal nature, he then has the individual right of access, withdrawal and rectification provided for by law and may in this regard have the information concerning him which would no longer be relevant.
Registration in the Bloctel service only concerns canvassing by telephone call. In the event of receipt of fraudulent SMS, the consumer can transfer it to 33,700. Depending on the choices issued when creating or consulting their accounts on the Internet, customers will be likely to choose whether they wish to receive offers from JSR, or be informed of specific operations via e-mail. If a customer no longer wishes to receive these offers, he will be able to request them at any time by clicking on an electronic link available on emails for this purpose, or by modifying his account directly on the izac.fr website.

In accordance with the provisions of articles L.223-1 and L.223-2 of the Consumer Code, the customer who does not wish to be the subject of commercial prospecting by electronic means or by telephone may register for free opposition list by sending a request to this effect by email to customer service at the following address serviceclient@izac.fr.

 

Article 13: Rights of intellectual property
The "IZAC" brand, as well as all of the figurative brands or not and more generally all other brands, illustrations, images and logotypes appearing on IZAC articles, their accessories or their packaging, whether it is deposited or not, are and will remain the exclusive property of the company JSR. All total reproduction or partial reproduction, modification or use of these brands, illustrations, images and logotypes, Whether without express and prior agreement of the JSR company, is strictly prohibited. It is the same with any combination or conjunction with any other brand, symbol, logotype and more generally any distinctive sign intended to form a composite logo. The same goes for all copyrights, drawings and models, patents which are the property of the company JSR.

 

Article 14: force majeure
The execution by the company JSR of all or part of its obligations will be suspended in the event of a fortuitous case or force majeure which would embarrass or delay its execution.

Are considered as such, in particular, without this list being limiting, war, riots, insurrection, social disorders, strikes of all kinds and the supply problems of JSR.

JSR will inform the customer of a similar or force majeure in the seven (7) days of its occurrence. In the event that this suspension continues beyond a period of fifteen (15) days, the Customer would then have the possibility of terminating the current order, and it would then be reimbursed under the conditions set out in article 8 of these General Conditions of Sale.

 

Article 15: Applicable law
These general conditions of sale are subject to French law. In the absence of an amicable settlement of their dispute in accordance with the stipulations of article 10.

Any dispute likely to result from the interpretation or execution of these general conditions of sale and its consequences will be subject to the exclusive jurisdiction of the French courts of the place of domicile of the customer.
